There's a cost benefit trade off here though - we could go after them with guns blazing, but that's expensive. A stroppy letter is probably a good place to start - sounds like we have grounds...

Assuming you are first with this design, you should notify their host with the same information. Canada doesn't have the Digital Millennium Copyright Act, but its existing copyright legislation is good enough. The host should be able to come to the same conclusion. If you are planning to sue, get in an expert to make a finding of "objective similarity". This is submitted with your statement of claim in a Canadian court. I believe your defendant has to disprove the finding by producing draft drawings. It's a very high standard of proof. I still would notify their ISP at the very least as copyright is global—the border has no effect on whether your copyright is recognized in Canada or not. Usual disclaimer: seek legal advice, blah blah blah, and I don't need to stand by the above, etc.</description>
